1. Acceptance of Terms
These Terms of Use (“Terms”) are an agreement between you and PresenceHub (“PresenceHub”, “we”, “us”, or “our”) governing your access to and use of the PresenceHub service, including our website, applications, and APIs (together, the “Service”).
By creating an account or using the Service, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not use the Service.
2. Eligibility
You must be at least 13 years old to use the Service, and old enough to form a binding contract in your jurisdiction (or have the consent of a parent or legal guardian). Because the Service publishes to third-party social platforms, you must also meet the minimum age requirements of any platform you connect.
If you use the Service on behalf of a business or other organization, you represent that you have authority to bind that organization to these Terms, and “you” refers to that organization.
3. Your Account
When you create an account, you agree to:
- Provide accurate, current, and complete information, and keep it up to date.
- Keep your password confidential and not share your account credentials with others.

You are responsible for all activity that occurs under your account. We may suspend or terminate accounts that violate these Terms.
4. The Service
PresenceHub lets you connect social media accounts, compose posts with text and media, schedule them, and publish them to your connected channels. Features of the Service may change over time as we add, modify, or remove functionality.
The Service is currently offered free of charge. We may introduce paid plans or paid features in the future; if we do, we will provide notice and updated terms before any charges apply to you.
5. Your Content
You retain full ownership of the content you create and upload to the Service, including post text, captions, images, and videos (“Your Content”).
So that we can operate the Service, you grant PresenceHub a limited, worldwide, non-exclusive, revocable license to host, store, reproduce, process (including applying edits you request, such as cropping or trimming), and transmit Your Content to the third-party platforms you connect — solely for the purpose of providing the Service to you and at your direction. This license ends when you delete Your Content or your account, except to the extent copies must be retained for legal or backup purposes, or where content has already been published to a third-party platform.
You are solely responsible for Your Content, and you represent that you have all rights necessary to upload it and to publish it to the platforms you connect. Our handling of your personal data is described in the Privacy Policy.
6. Acceptable Use
You agree not to use the Service to:
- Create, schedule, or publish content that is unlawful, defamatory, harassing, hateful, or that infringes the intellectual property or other rights of any person.
- Send spam, engage in deceptive or manipulative posting practices, or artificially inflate engagement on any platform.
- Upload malware or other harmful code, or attempt to interfere with or disrupt the Service.
- Attempt to access accounts, workspaces, or data belonging to others without authorization.
- Resell, sublicense, or misuse the Service, or access it by automated means except through interfaces we provide.
We may remove content or suspend accounts that we reasonably believe violate this section.
7. Third-Party Platforms
The Service publishes to third-party platforms such as Facebook and Instagram. Your use of those platforms is governed by their own terms and policies, and you agree to comply with them (including Meta’s terms) when publishing through PresenceHub.
We do not control third-party platforms and are not responsible for their actions, including rejected or removed posts, account restrictions or suspensions, changes to their APIs, or interruptions in their availability. Connecting a platform account authorizes us to act on your behalf with that platform as described in these Terms and the Privacy Policy.
8. Workspaces and Teams
The Service is organized into workspaces that can be shared with team members. If you invite members to a workspace, content and connected channels in that workspace may be visible to and usable by those members according to their roles.
Workspace owners are responsible for who they invite and for the actions members take within their workspace. If you join a workspace, you are responsible for your own actions within it.
9. Service Availability
The Service is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not guarantee that the Service will be uninterrupted, error-free, or that scheduled posts will always publish successfully — publishing depends on third-party platforms and may fail for reasons outside our control. You should not rely on the Service as your only record of Your Content.
10. Limitation of Liability
To the maximum extent permitted by applicable law, PresenceHub will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or goodwill, arising out of or related to your use of the Service, even if we have been advised of the possibility of such damages.
To the maximum extent permitted by applicable law, our total liability for all claims relating to the Service will not exceed the greater of the amount you paid us for the Service in the 12 months before the claim arose or [amount].
Some jurisdictions do not allow certain limitations of liability, so parts of this section may not apply to you.
11. Termination
You may stop using the Service at any time and may request deletion of your account by contacting us at [contact email].
We may suspend or terminate your access to the Service if you breach these Terms, if required by law, or if we discontinue the Service. Where reasonable, we will give you notice before termination. Upon termination, your right to use the Service ends and we may delete Your Content in accordance with the Privacy Policy. Content already published to third-party platforms remains on those platforms unless you remove it there.
